Media (Video & Image) Usage Agreement

1. The submitter has obtained all required legal releases to use the images contained in their submission. Whistler Blackcomb is in no way responsible for obtaining image use releases from those depicted within photos, videos or other types of content submitted. The submitter is solely responsible for handling all claims or inquiries concerning images contained in their submitted content, and all inquiries will be directed to the submitter.

2. The submitter has obtained any required legal license to use music, sound affects, company logos and/or other copyrighted, trademarked or licensed materials utilized within videos, photos or other content. Whistler Blackcomb is in no way responsible for verifying proper licensing. The submitter is solely responsible for handling any inquiries regarding these types of issues, and all claims will be directed to the submitter through provided contact information.

3. All submissions become the property of Whistler Blackcomb, and will not be returned, duplicated or produced for the submitter. By submitting any type of content to Whistler Blackcomb, the submitter acknowledges and agrees that Whistler Blackcomb may use the submitted content in any way, with or without crediting and/or notifying the submitter.

4. The submitter affirms that the content does not contain any images, footage, language, sound affects, or the like that could be considered illegal, offensive, lewd, violent, sexual or destructive behavior, whether real, acted out or implied. Whistler Blackcomb is in no way responsible for the content of the submissions. The submitter will be solely responsible to handle any questions or legal issues arising from questionable content.

5. By submitting any content to Whistler Blackcomb, the submitter acknowledges that they have read, agreed to and complied with all terms in this agreement.

6. It is contractually agreed that no dispute of any kind may be filed by the submitter against or pertaining to Whistler Blackcomb, Intrawest Corporation, it's employees or representatives.

7. If any portion of this agreement is deemed unenforceable, the remainder shall be an enforceable contract between the submitter and Whistler Blackcomb.
